These Terms of Service (“Terms”) govern your access to and use of the website operated under the brand name Zoncute (“Zoncute”, “we”, “our”, “us”). Zoncute is a brand name (DBA) of Ascendant Apex LLC, a Florida limited liability company (“Ascendant Apex LLC”). The website is www.zoncute.boutique (the “Website”).

By accessing or using the Website, you agree to be legally bound by these Terms and the policies referenced here, including our Privacy Policy, Refund & Return Policy, and Shipping Policy (collectively, the “Policies”). If you do not agree, you must discontinue use immediately.

For purposes of these Terms:

  • “User / Customer” means any individual or entity accessing, browsing, interacting with, or purchasing through the Website.

  • “Account” means an optional profile created by Users to manage purchases and preferences.

If you create an Account, you agree to:

  • keep your login credentials confidential;

  • be responsible for all activity under your Account; and

  • notify us immediately of unauthorized access or suspected breach.

We are not liable for losses resulting from failure to safeguard your credentials.

5) Product Information and Availability

We strive to provide accurate product information; however:

  • product descriptions, images, and details may contain errors or variations;

  • colors and appearance may differ due to device settings and display differences;

  • availability may change without notice; and

  • we may update, limit quantities, or discontinue Products at any time.

6) Pricing, Payments, and Order Confirmation

Prices are shown in USD and may change at any time before an Order is placed.

If an obvious pricing error is identified before processing or shipment, we may cancel the Order or contact you to confirm a corrected price.

An Order is accepted only when we send an order confirmation email. We reserve the right to cancel Orders for reasons including, but not limited to:

  • Product unavailability,

  • payment verification issues,

  • suspected fraud,

  • system or typographical errors.

If we cancel an Order after payment, we will issue a refund to the original payment method.

7) Gift Cards

We do not sell gift cards at this time. If gift cards are offered in the future, Klarna not be available for gift card purchases.

8) Shipping, Delivery, Address Accuracy, and Delivery Issues

Delivery times are estimates and may vary due to carrier performance, weather, peak seasons, or other events outside our control.

Address accuracy: You are responsible for providing a complete and accurate shipping address. If an Order is returned due to an incorrect or incomplete address, additional shipping charges may apply to reship the Order.

Lost, missing, or damaged packages: If your package appears lost, missing, or arrives damaged, contact us at support@zoncute.boutique. We will assist by:

  • verifying tracking and delivery status,

  • initiating a carrier inquiry or claim when applicable, and

  • working with you toward a reasonable resolution (replacement, reshipment, store credit, or refund), depending on the circumstances and eligibility under our Policies.

Delivered but not received: If tracking shows “delivered” but you did not receive the package, please check with household members, neighbors, and your local carrier. We will still help you investigate. Outcomes may depend on carrier findings and available proof of delivery.

9) Fulfillment Partners & Packaging (Including Amazon Fulfillment)

We may fulfill Orders using third-party logistics and fulfillment partners (“Fulfillment Partners”). This may include Amazon fulfillment, such as Buy with Prime / Multi-Channel Fulfillment (MCF), for eligible Products.

You acknowledge and agree that:

  • Products may ship from a partner facility, and carriers/packaging may vary;

  • Orders may arrive in non-Zoncute-branded packaging;

  • Zoncute remains responsible for customer support and handling Order issues in accordance with these Terms and our Policies; and

  • to fulfill your Order, we may share limited customer information (name, shipping address, contact details) with Fulfillment Partners and carriers strictly as necessary for delivery.

10) Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed solely by our Refund & Return Policy. We may refuse requests that do not meet policy requirements.

11) No Professional Advice / No Consulting Services

Any information on the Website (including product descriptions, guides, tips, or customer support responses) is provided for general informational purposes only and is not professional advice (legal, financial, medical, or otherwise). Zoncute does not provide consulting services. You are responsible for determining whether a Product is suitable for your needs.

12) Intellectual Property

All Website content—including text, graphics, images, logos, designs, and code—is owned by Zoncute or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or exploit any content without prior written permission.

13) Third-Party Links and Services

The Website may include links to or integrations with third-party services (such as payment providers, carriers, social platforms, or embedded apps). These third parties operate independently and have their own terms and privacy practices. We are not responsible for third-party content, policies, or services. Your use of third-party services is at your discretion and risk.

14) Feedback and Reviews

If you submit reviews, comments, suggestions, or other content (“Feedback”), you grant Zoncute a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial purposes. You represent that you own or have necessary rights to submit Feedback and that it does not violate third-party rights.

15) Corrections, Errors, and Omissions

We may correct errors, inaccuracies, or omissions and change or update information at any time without prior notice, including after an Order is submitted.

16) Disclaimer of Warranties

To the maximum extent permitted by law, the Website, Services, and Products are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not guarantee uninterrupted, timely, secure, or error-free operation.

17) Limitation of Liability

To the fullest extent permitted by law, Zoncute shall not be liable for indirect, incidental, punitive, special, or consequential damages. Zoncute’s total liability shall not exceed the value of the Order giving rise to the claim.

18) Indemnification

You agree to indemnify and hold harmless Zoncute, Ascendant Apex LLC, and our officers, directors, employees, agents, contractors, licensors, and service providers from claims arising out of your misuse of the Website, violation of these Terms, or violation of any law or third-party right.

19) Force Majeure

We are not liable for delays or failures caused by events beyond our control, including natural disasters, technical failures, carrier disruptions, or government restrictions.

20) Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute will be resolved exclusively in state or federal courts located in Florida, and you consent to personal jurisdiction and venue in such courts.

Your use of the Website is subject to our Privacy Policy.
